DMCA Protection and
Enforcement Policy
Effective date: [06-18-25]
1. Zero-Tolerance Approach to Unauthorized Distribution
ColorReel’s Lightroom presets and all accompanying assets are the exclusive intellectual property of Maximillian Held, d/b/a ColorReel. Any unapproved sharing, uploading, or resale—whether online (websites, file-sharing forums, social media) or offline—constitutes copyright infringement and violates the Digital Millennium Copyright Act (“DMCA”). We do not allow “free download” reposts, bundle resales, or any other form of redistribution.
2. Monitoring & Enforcement
We proactively scan the web for infringements. When we find unauthorized copies, we will immediately:
-
File DMCA takedown notices with hosting providers, search engines, and relevant platforms.
-
Issue cease-and-desist letters to the responsible parties.
-
Seek all legal remedies available, including injunctive relief and monetary damages, in U.S. or international courts as appropriate.
3. Consequences for Violators
Individuals or entities who redistribute our presets without permission may be liable for:
-
Statutory damages of up to $150,000 USD per work under 17 U.S.C. § 504.
-
Actual damages, lost profits, and any unjust enrichment.
-
Court costs and attorneys’ fees.
ColorReel will pursue these remedies to the fullest extent permitted by law.
